Terms of Service
Terms of Service for Tin Can Smartphone / SMS-Api-Gateway (“the Service”), operated by Albrecht Apps GmbH, Falkenstraße 9, 49610 Quakenbrück, Germany.
1. Scope
These terms apply to use of the website, account, REST API, and Android companion app. By creating an account, accepting an invitation, or using the Service, you agree to these terms and our Privacy Policy.
2. The Service
The Service lets you send and receive SMS through an Android smartphone you control, via our cloud backend and companion app. You are responsible for your device, SIM, mobile carrier contract, and compliance with local telecommunications and spam laws.
3. Accounts and access
Registration may be invitation-only. Keep credentials and API tokens secret. You are responsible for activity under your account. We may suspend or terminate access for abuse, security risk, or breach of these terms.
4. Acceptable use
You may not use the Service for unlawful content, unsolicited bulk messaging (spam), fraud, harassment, or to infringe others’ rights. You must not attempt to disrupt the platform or reverse-engineer it beyond what the law allows for interoperability.
5. Fees and refunds
Paid plans, if offered, are billed as described at purchase. Refunds are governed by our Refund Policy. Carrier SMS charges on your own SIM remain your responsibility.
6. Availability and changes
We provide the Service on a commercially reasonable basis and may change or discontinue features. Beta or invitation-only phases may be limited or unstable; we do not guarantee uninterrupted availability.
7. Liability
To the extent permitted by law, Albrecht Apps GmbH is not liable for indirect or consequential damages, lost profits, or damages caused by your carrier, device, or misuse of the API. Mandatory consumer rights remain unaffected. Liability for intent and gross negligence is unrestricted.
8. Intellectual property
The Service software, branding, and documentation remain our property (or our licensors’). You retain rights to your own message content and configurations.
9. Privacy
Personal data is processed as described in our Privacy Policy.
10. Governing law
These terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected. Place of jurisdiction for merchants is Quakenbrück / Osnabrück, Germany, where permitted.
